WARRANTY
Evento Company Limited, New Zealand warrants this product against defects
for a period of twelve (12) months from the date of delivery, during
which time goods returned will be repaired as set out below. Evento Company
Limited will repair free of charge any part of the product that is found
to be defective within the specified period, providing the product has
been used in accordance with the instructions, and has not been subject
to misuse, neglect or accident, nor modified or repaired by any person
other than a representative of Evento Company Limited.
PAYMENT
Twenty five percent (25%) of the total invoice amount payable upon
written order and the balance payable prior to shipping or collection
of the goods. Payment can be made by telegraphic transfer (TT), credit
card or money order, payable only to Evento Company Limited. All
prices and costs are in US dollars, unless otherwise stated. A 1.9%
surcharge will be charged on credit card orders. OWNERSHIP
Ownership of the goods is retained by Evento Company Limited, until
payment has been made in full for all the goods. If the goods are
sold by purchase order to the customer prior to payment then the
proceeds of the sale shall be the property of Evento Company Limited. USE AND INDEMNIFICATION
"
Buyer" (person, company or entity purchasing the product or device),
is solely responsible for the manner of use of the product and other
equipment purchased from Evento Company Limited. "Buyer" is
solely responsible for all signage, labels and warnings to consumers
or other users of the product or device, and for any and all other
acts necessary, including user warnings and limitations (e.g., weight,
height, age, number of participants and medical condition limitations),
to ensure the safety of the users. "Buyer" acknowledges that
they have received, read and fully understand all necessary instructions
for the safe setup and operation of their Evento Company Limited product
or device. "Buyer" agrees to operate their Evento Company
Limited product or device according to the instructions established
by Evento Company Limited. "Buyer" agrees to operate their
product or device according to all state and local requirements. "Buyer" agrees
to train any person(s) operating the product or device in the safe
operation of the product or device including safe handling of emergency
situations. "Buyer" shall use applicable devices, such as,
but not limited to; helmets, barriers, protective clothing, footwear,
etc., necessary to ensure the safety of users and the general public. "Buyer" agrees
to indemnify, defend and hold harmless Evento Company Limited and Evento
Company Limited Insurers from actions and claims of third parties,
including customers of "Buyer" and users of the goods and
products sold to "Buyer", arising out of or in connection
with the use of the goods and products herein described or resulting
from the breach of the provisions in this ‘Purchase Order Form’ by "Buyer".
In the event Evento Company Limited is required to commence an action
to enforce this provision, “Buyer" shall pay all of Evento
Company Limited legal costs and expenses. DELIVERY
Goods are shipped airfreight internationally, with central distribution
from Napier, New Zealand. Shipping and handling may be invoiced separately
by Evento Company Limited or by authorized shipping agent. Goods
are delivered within fourteen working days from receipt of full payment
(or as otherwise stated), unless in circumstances beyond Evento Company
Limited's control including war, insurrection, fire, flood, strikes,
lockout, delays in transportation, breakdown of machinery, embargoes,
prohibitions or other action by any government or local authority. DUTY & ASSOCIATED COSTS
Evento Company Limited is not responsible for any duty, agents charges,
local taxes and or associated costs incurred upon arrival of the
product in the country of destination. These costs are the sole responsibility
of the purchaser (unless otherwise stated).
